As an international metropolis, Shanghai attracts many foreigners to work here. It is vital for employers or foreign job seekers to understand the process of applying for a working visa. According to Chinese laws, foreigners working in China must apply for a working visa to legally obtain employment and enjoy the protection of China's labor law.

 

1.Conditions
a.Employment License for foreigners
b.Employment certificate for foreigners
c.Health certificate
d.Hold a valid passport or other international travel document that can replace the passport
e.No criminal record
f.Age limit is above 18 and under 55 (for female) or 60 (for male)
g.Definitive employer

 

2.Procedure
a. Employers should apply for the employment permit certificate for foreigners before they entry China.
b. Employers should obtain the invitation letter from the municipal foreign economic and trade commission;
c. Foreigners shall apply for Z visa at the local Chinese embassy with the employment permit certificate and notice letter;
d. After entering the country with a Z visa, foreigners shall go through physical examination or confirmation procedures at designated medical institutions.(apply for the employment permit for foreigners within 15 days after entry);
e. After passing the physical examination, apply for the registration form of temporary residence (issued by the public security bureau);
f. Handle the employment permit for foreigners;
g. Apply for residence permit at exit-entry administration bureau with temporary residence registration form. Holding employment permit and residence permit could be legally employed in China and shall be protected by law.

 

3.Documents required for Physical verification
1. A valid original passport or travel document, and photocopies of the photo-page, expiry-date-page and info.-update-page of your passport or travel document
2. Four recent 2-inch photos (full face without hat)
3. Copy of company’s registration certificate
4. Original physical examination records issued by overseas medical institutions(done within last 6 months).

 

4.What does the company need to recruit foreign employees?
Recruiting party should set up according to law, without any record of serious violation of the law. Foreigners should be employed for with special needs and there is a temporary shortage of suitable candidates in China, which does not violate the relevant state regulations. The salaries paid to foreigners employed shall not be lower than the local minimum standard. Where laws and regulations require pre-approval by the competent industrial authorities, the approval shall be obtained.

 

5.How to renew the working visa if the job changed in China for foreigners?
a. The old employer should provide the Certificate of Resignation
b. Apply for the employment permit certificate by the new employer and the old one should be canceled by the old employer
c. business license, social security card (foreign capital enterprise need approval certificate, the entry and exit for the record), labor contract, foreigners with bachelor degree, 2 years working experience in overseas certificate (if in China has already got more than 2 years of work in sign, can use signed copy), passport photos, accommodation proof.
