Invalidation of a Registered Trademark

If a party determines that a registered trademark infringes on his or legal trademark rights he or she may file a request for invalidation of the trademark in question.  Articles 50 and 51 of the Trademark Act delineate the procedures for filing an invalidation request.  Invalidation requests must be filed within five years of the trademark's original publication date.  Unlike requests for opposition, only interested parties may file requests for invalidation. 

 

A party filing an invalidation request must submit an application for invalidation including a statement of reasons for invalidation, processing fees, two copies of the evidence relevant to the request, and photocopies of documents demonstrating the requesting party's identity.  If appointing a trademark agent, a power of attorney must also be submitted with a Chinese translation.  A committee of three examiners will be appointed to review the request and determine whether invalidation is necessary.
