The definition for trademark
A trademark is a sign that serves the purpose of identifying the goods or services of a producer, thus allowing the consumers to distinguish goods or services of one producer from those of another. The sign may be composed of words, devices, letters, numerals, three-dimensional signs (shapes), combinations of colors or any combinations of the above.
China trademark registration --- the needed materials :
(1) A simple Power of Attorney (POA) signed by the applicant (to be prepared by Kaizen).
(2) A duly completed trademark search/registration order form (to be provided by Kaizen).
(3) A soft copy of the trademark in JPEG format.
(4) A copy of identity proof of the applicant (passport for individuals and business registration licence/certificate for corporation).
Procedures for China trademark registration
1: Clients send to ATAHK (by email or fax or post) a specimen of the trademark, a detailed list of products to be covered by the trademark and at the same time make payment for the pre-filing search to ATAHK by remittance or check;
2: ATAHK conduct the pre-filing search and prepare search report and email the search reports to clients;
3: (If the search results indicate that the application is likely to be accepted and clients decide to proceed) Clients send us the Photostat copy of identity proof (passport copy for individual and Certificate of Incorporation or Business Registration Licence) and at the same time make payment for the pre-filing search to ATAHK by remittance or check;
4: ATAHK prepare the registration application forms and Power of Attorney (PoA) and deliver them to clients for execution;
5: Clients send the duly executed PoA and registration forms back to us;
6: ATAHK submit the application documents to the Trademark Registration Bureau
7: The Trademark Registration Bureau perform examination and other procedures; if no objection received, the Trademark Registration Bureau then issues the Certificate of Registration;
8:ATAHK forward the Certificate of Registration to clients.
